Is gay marriage legal in Hawaii? Can two non-residents go to Hawaii and get married in a civil ceremony?

  2. No. Marriage equality only exists in Massachusetts, at least in America. Over a decade ago, the Supreme Court of Hawaii moved to have marriage equality, but - if my memory serves me correctly - there was an amendment to the constitution to prevent that from happening. Instead, I'm pretty sure that Hawaii allowed some forms of "domestic partnerships" - they're not anything remotely as good as marriages, in terms of benefits, but it should allow people to share insurances, etc. So, short answer is no. The long answer is that a lot of things happened and Hawaii almost had it, but it ended up being blocked. It's a pretty interesting read, well worth the time if you have it. A lot went down and my memory is a bit fuzzy on the specifics at this point, but I do know for a fact that there is no marriage equality there.

The conservatives are trying to make it so that only residents of Massachusetts can marry here, but that flies in the face of marriage as a whole. The same would have to apply equally to heterosexual marriage. An important point to remember is gay marriages were not voted in by any ballot referendum. It was ordered by the Massachusetts Supreme Judicial Court. It may not be superceded by any legislation to the contrary. It was a non-appealable ruling. The Court cited the Massachusetts Constitution as the source of its determination.
